STABILISATION LEVY MADNESS CONTINUES. 

Persons not filing a zero return or filing late are being asked to pay late fees. Silly isnt it?

The Interim Stabilisation Levy ACT at Section 9 (1) states “every employer who is required to make levy deductions from the remuneration of his employees under Section 5 shall, not later than 10 days after the end of each month – (a) file a return”.

One would like to think that this section is ONLY applicable to the self-employed that make over $2000 for the month. No one should be charged late fees if they haven’t made an income of over the $2000 for the month. ZERO FROM ZERO LEAVES NOTHING, that is 0 - 0 = 0.

Well that section of the law (Section 9 (1)) under which The Government of Anguilla claimed they were acting in accordance with to charge persons late fees for non-filing or late filing of a Zero Balance, was challenged. This challenge has been upheld.

As such, all outstanding amounts for late filing penalties will have to be removed from persons' accounts. Likewise it is believed that all persons who were charged and paid for late filing fees under the same circumstances will have to be refunded the monies they paid.

All affected person should contact the Department of Inland Revenue for Clarity on this.
